Terms & Conditions And Data Notice & Data Usage Policy

It is important that you take the time to read these terms and conditions before enrolling on one of our courses as it covers important information on payment plans, refunds, cancellations and changes to courses after enrolment.

By using our website you have agreed to accept these Terms &ย Conditions and our Data Notice, managed in accordance with the Data Policy, below

We may make non-material changes to these policies and notices without letting you know, you also agree to check this page for any changes from time to time. ย You will be invited to agree with any material changes to our agreement before they are effective.

Parties

Blossom & Berry Training Limited is the trading name of the business located at of 17 Spindrift Way, Essex, CO7 9GW. ย Any notice or communication to Blossom & Berry should be sent by email to; [email protected].

Your details will be as per the form that you will send us on enrolment of our courses or on any order for products.

Instalments and Payment Plans

If we have agreed that you can pay for any products or services by instalment or payment plan, you agree to make the payments on the same date every month regardless of circumstances including situations such as illness, unemployment, maternity leave etc.ย  Provision should be made (eg; savings/income protection/insurance etc) that in the event of any such circumstances, your commitment to pay Blossom & Berry will not be affected and will be paid on the date agreed. In the event that you do not honour this commitment and complete the payments, or if an instalment is late, Blossom & Berry reserves the right to demand payment of the outstanding balance which will become payable as a debt and may incur additional credit enforcement charges. We reserve the right to demand full payment of outstanding amounts on the default of any one monthly instalment.

In the event of defaulting on a payment, we will write to you to request you make payment of the instalment amount. If we do not hear from you within 14 days of requesting payment, we reserve the right to remove you from the course and no longer mark your work or provide the tuition. We also reserve the right to take further action to recover this debt.

In the event that we demand the return of any materials supplied, you hereby agree that you will not make any copy of the materials or make use of any copies or other materials derived from those being returned.

No course certificate will be provided (if otherwise appropriate) if there are any outstanding fees due to Blossom & Berry in relation to that course or program.

If you wish to re-apply to join Blossom & Berry at a future date any monies previously paid will be forfeited upon your suspension from the course.

We reserve the right to remove you from any Blossom & Berry social media group or to suspend communication with you while any money is outstanding and/or to send details of any debts to a factoring or other debt-collecting agency.

Descriptions of products

We make every effort to show and describe our products as accurately as possible, however, slight variations may occur.

All quoted weights, dimensions and capacities are for guidance only. Colours of items viewed on a computer monitor can vary from the actual product depending on the calibration and colour settings of individual computer screens.

If you are unsure of your computerโ€™s colour settings, refer to the user manual or seek advice. We cannot accept responsibility for errors resulting from poorly adjusted monitors.

Returns, Refunds,Cancellations & Changes For Online Courses/Digital Products

Please be aware that due to the immediate delivery of our online and digital courses we are unable to offer any refunds, changes, or, in the case of payment/instalment plans, any cancellations after enrolment. (See above for full terms and conditions)

Please, therefore, make absolutely sure that before you enrol on any of our courses you take the time to research it fully by reading the full course description and content (found on the training tab) and have taken all steps necessary to ensure that this is the right course and training provider for you.ย  If you are unsure then Gayle is available for a call and you can email any questions to [email protected].ย  We are unable to offer any refunds, cancellations or changes to courses after enrolment.

Refunds, Cancellations & Requirements For In-Person Training

Course cancellation by the student

If you cancel prior to 12 weeks before the start of the course, we will refund the full course price minus the non-refundable deposit.

If you cancel your place less than 6 weeks before the first day of the course, Blossom & Berry is unable to offer you a refund. We will endeavour to offerย the course place to another student, to the extent that this is possible we will seek to refund some or all of the remaining balance.

If you need to leave the course for any reason once the course has started, we are unable to offer you a refund or defer your course place.

If you are on a monthly payment plan, all instalments will need to be settled before the course starts.

If you cannot attend a day of the course then the additional time can be caught up via our online course or in additional training which is payable by you for the instructorโ€™s time and expenses.

Course cancellation by Blossom & Berry

In the unlikely event of extenuating circumstances, Blossom & Berry reserves the right to cancel the course at any time. If the course is cancelled prior to the course starting, the course may be rescheduled and if students cannot attend the new course then 100% refunds will be made. If the course is cancelled partway through the course, Blossom & Berry will rearrange the remaining modules of the course and if this is not possible for students to attend and

EQUIPMENT FOR THE TRAINING

For the in-person training course you must bring;

A yoga mat
A baby demonstration doll
A notebook and pen
Three yoga blocks

LUNCH

Tea and coffee are provided but please bring your own lunch. Please inform us of any allergies in advance.

PRE-READING LITERATURE

You will receive a pre-reading list prior to the start of the course, books must be purchased by the students and arenโ€™t included in the course cost.

VENUES

Blossom & Berry chose venues for training which support informal group learning. If a training venue is unsuitable, Blossom & Berry reserve the right to switch the venue to another one in close proximity. Students must be respectful of training venues and are responsible for any damage or breakages in the property.

BOOKING FORM

Students must return their booking form before they attend their training course so that we can make provision for students before they arrive on the course. It is studentsโ€™ responsibility to let Blossom & Berry know of any additional needs, special requirements or allergies/health conditions before they arrive on the course.

PHOTOGRAPHY

We reserve the right to photograph or film during the programme and to use these images for our website and marketing purposes.

COMPLAINTS

If you have any complaints regarding our in-person training, please raise them with the instructor at the course and we will try and remedy them as much as we can and provide you with what you need. It is difficult to remedy issues regarding the in-person training after the event so we ask you to act whilst on the course. Any complaints after the course can be emailed to [email protected]

Offers

From time to time you may receive offers relating to our courses, once enrolled on a course and payment for the course has commenced, you are not able to access any other discount code or special offer on the course you are enrolled on and have paid for.

You cannot use two separate codes or offers on the same product.

We reserve the right to withdraw any offers that you may have received in error in the event of any dispute.

Postage, Packaging and Delivery

Blossom & Berry products are kept on site. Other products ordered from us may be sent to you straight from the manufacturer. In the unlikely event we are out of stock after you have placed your order we will let you know and advise when we can delivery can be made. If you prefer you can ask for a refund (see below).

We aim to dispatch your products within 14 days of the order being received, however, we deal with orders as quickly as possible. ย If there will be a longer delay in processing the order we will contact you. We process orders at 1pm each day.

P&P Costs: UK orders cost ยฃ2.99. Contact us for postal rates for Europe and the Rest of the World Europe. We do not ship to the US or UAE.

Valuable items are sent by recorded delivery which will need to be signed for on delivery. If you are out when delivery is attempted you will receive a card asking you to arrange a suitable delivery time, please respond to this promptly. If you need your purchases urgently we can usually offer an express delivery service. Please email us for details.

If your order contains products that are sent directly from the producer, you may receive two or more parcels. Return details for products sent directly from a producer will be sent with these parcels and will differ from the details in relation to Blossom & Berry products.

Prices &ย Payment

All prices are correct as they appear on the website. We may change prices from time to time or have offers available for a limited time.

The most simple way of placing an order is via our secure online shop using your credit or debit card or using Paypal.

Privacy Policy

Your privacy and the way with which we deal with personal data is set out in our Data Notice and Policy set out below.

Governance

We will supply the goods to you as per your order, in accordance with these Terms and Conditions.

This website, it's content and any orders placed via the site are governed by and in accordance with English law. By placing an order with Blossom & Berry you hereby agree to submit to the sole jurisdiction of the courts of England and Wales. Blossom & Berryโ€™s liability for any claim howsoever arising shall not exceed the price of the goods supplied by Blossom & Berry to the customer: Blossom & Berry shall not be liable for any consequential customer loss whether this arises from a breach of duty in contract or in any other way.

Your statutory rights are not affected by this statement.

Data Notice

This notice sets out the purposes for which your data will be used by Blossom & Berry.

It applies to all students, customers, clients, suppliers of and volunteers for Blossom & Berry. Its purpose is to ensure that Blossom & Berry complies with the law and with high data protection standards.

In this notice and in the policy below โ€œpersonal dataโ€ means any recorded information which identifies a living individual.

Purposes

Blossom & Berry retains and shares your personal data as set out in the Data ย Policy, below.

Blossom & Berry Students, Graduates & Teachers

As a student, you hereby consent to Blossom & Berry processing and retaining your personal data for the purposes of enrolling you and managing you during your course and keeping in touch with you after you have graduated. Students, graduates and teachers also agree that we can process your data to keep you up to date about events and other news and/or to inform you about any special offers from Blossom & Berry. This will also enable us to inform you about any changes in professional practice.

Visitors to our website and customers

Where you have provided your email in relation to creating an account, purchasing a product or signing up to receive a free download of any materials, we willย store your email address to send you information about our services to keep you up to date about events and other news and/or to inform you about any special offers from Blossom & Berry. If we are working with a third party to provide you with a product order via drop-ship we will need to share your data with this third party to enable them to fulfil your order.

Signing up for Active Campaign

If you sign up to join our mailing list, you hereby agree to keep you up to date about events and other news and/or to inform you about any special offers from Blossom & Berry.

You can withdraw your consent and request erasure of your data at any time by informing us in writing (however any student withdrawing their consent will not be able to graduate and may not be entitled to a refund of any fees paid or a waiver from any fees due).

Blossom & Berry shall not collect or store your personal data for anything other than the purposes above.

Data Policy

This data protection policy regulates how Blossom & Berry processes and stores personal data of its members.

It applies to all employees, officers, members and volunteers. Its purpose is to ensure that we comply with the law and with high data protection standards.

Blossom & Berry processes, retains and shares personal data of members for the purposes set out in the Data Notice above.

Your data rights

You may request that we provide you with a copy of all personal data that we hold about you. We shall provide a copy of all information in accordance with our legal obligations and we will rectify any incorrect personal data held by us about you upon being notified of any mistakes.

Sharing data with third parties

If we are working with a third party to provide you with a product order via drop-ship we will need to share your data with this third party to enable them to fulfil your order. We also store data in our secure drive on Google and our computer system is backed up by PC worldโ€™s Cloud Storage system, Know-How. Where you have consented to join a whats app phone group, your information will be added to a whats app. Where you have requested to join a Facebook group, your information will be held by Facebook.

Review

We shall periodically review the security of our records and processing activities and shall take appropriate steps to ensure the confidentiality, integrity and availability of personal data that we hold.

Withdrawal of Support

For clarity I thought I would set out the following;

I am here to help you develop your business but as a teacher, you are not able to use our materials and resources to set up a teacher training organisation.

If you want to set up your own training school, you will be asked to leave the collective and return all resources and lifetime access to the course will be revoked. I will no longer be able to offer you mentorship or coaching as part of B & B or my mentorship programs as Gayle Berry

Using the names of my programs directly is not allowed.

Blossom & Berry is built on the values of trust, respect and service and so when I create and share my knowledge and materials I have an expectation that they will not be directly used to create competition. In addition, selling courses or creating a competitive community through networking with teachers in this group in a non-transparent way will also mean you will be asked to leave the collective
